A Kado Grade 1 Area Court in Abuja has sentenced a 34-year-old phone technician, Kelvin Okoje to two years imprisonment for defrauding his client of a phone worth N350, 000. Delivering judgement, the Area Court Judge, Mohammed Wakili, held that he convicted and sentenced the suspect based on his confession to the crime.
”The court having found Okoje guilty of the offence and taking into consideration his plea for mercy as a first time offender, hereby sentenced him to two years imprisonment with an option to pay N30, 000 fine, the judge said.
Wakili also ordered the convict to pay the sum of N350, 000 as compensation to the complainant as requested by the prosecutor and warned him to desist from committing crime in future.
Earlier, the Prosecution Counsel, Mr Stanley Nwafoaku, told the court that the convict, Okoje of Karmajiji village, Airport road, Abuja was arraigned on a two-count charge bordering on criminal breach of trust and cheating.
Nwafoaku said that one Mr Amedu Williams of Danjuma Street, Asokoro Abuja, reported the matter at Wuse zone 3 police station on Aug. 19, at about 6:00 p.m.
He said that on June 15 the complainant gave his IPhone 12 pro max, valued at N350,000 to the convict for repairs.
The Prosecution Counsel said that the convict dishonestly sold the phone and converted the money into his personal use.
Nwafoaku said during police investigation, the defendant admitted to the committing the crime.
He further stated that the offence contravene the provision of sections 312 and 322 of the penal code law (NAN)
